Mediation and Arbitration are forms of alternative dispute resolution whereby legal disputes through the consensus of the Parties are decided outside the Courts.
Arbitration is frequently used in resolving Corporate and Commercial disputes between Parties. Arbitration provides for a more flexible and confidential forum when by legal disputes can be resolved quicker, more efficiently and at times less costly than Court proceedings.
In Mauritius, local Domestic Arbitration is governed by the Civil Procedure Code while International Arbitration is conducted according to the International Arbitration Act 2008. Mauritius is positioning itself as a recognised jurisdiction and arbitral centre in the African region in International Arbitration matters.
